Students who Hack (and other Technology Misuses), What the Law Requires, Student Discipline and School Responses

Presented at SAINTCON 2019, Oct. 23, 2019, 9 a.m. (60 minutes).

In this presentation, presenters/school law attorneys will discuss local and national examples and cases about students hacking into school databases of various kinds. Presenters will outline how to determine if there is a "breach" of student data, how schools should respond and react, and possible legal and school consequences for students responsible. Time permitting, presenters will also provide an update on court cases about other student misuses of technology that affect school climate, safety and student wellbeing.

  • Carol Lear - LEAR & LEAR LAW OFFICES
    In the years before Carol Lear started a private education law practice group, she worked at the Utah State Office of Education (now the Utah State Board of Education office) for almost 30 years. While there, she supervised the Professional Practices Commission (UPPAC), wrote and updated administrative rules, was the GRAMA officer, tracked legislation that affected public education and worked with school districts and charter schools to provide information about public school legal issues. Carol was also a high school teacher (for 5 years) and an adjunct professor in the USU Education Leadership program (for 20 years). In 2016, Carol was elected to the Utah State Board of Education for District 7 (Salt Lake City and Park City)
  • Heidi Alder - LEAR & LEAR LAW OFFICES
    Heidi specializes in school law. She provides guidance on education-related legal topics such as FERPA, student data privacy, appropriate use of social media for teachers, first amendment rights for teachers and students, and due process rights for teachers and students. She also advises clients on employment matters, policy drafting, and special education laws and regulations. Prior to her current practice, Heidi was worked at the Utah State Office of Education as a School Law and an Investigator/Prosecutor for the Utah Professional Practices Advisory Commission.
